Legal Disclaimer & Intermediary Disclosure for EZYFIX
Last updated: 1 September 2026
Please read this disclaimer carefully before downloading, registering for, or using the EZYFIX application (the "Platform"). By accessing or using this Platform, you acknowledge that you have read, understood, and agree to be bound by the terms set out below.
1. Status as an Intermediary Marketplace Only
EZYFIX operates solely as an online intermediary marketplace designed to connect independent third-party service providers ("Tradesmen") with users seeking construction and maintenance services ("Customers"). EZYFIX is not a construction firm, contractor, project manager, or employer. Any agreement reached for services, quotes, or products is a direct contract strictly between the Customer and the Tradesman. EZYFIX is not a party to, nor responsible for, the outcomes, enforcement, or breaches of those independent transactions.
2. No Guarantee of Work, Services, or Products
While EZYFIX implements mandatory steps to verify that registered Tradesmen are real individuals or registered businesses (such as basic identity and operational checks), this verification process does not constitute an endorsement, qualification check, or guarantee of professional competence. EZYFIX makes no warranties or representations, express or implied, regarding the quality, safety, legality, timing, trade licensing, standard of craftsmanship, or suitability of any work, services, or products provided by Tradesmen.
3. User Due Diligence & Safety Measures
The Platform provides built-in functionalities allowing Customers and Tradesmen to directly request and exchange identification documentation, proofs of address, and references. Users are solely responsible for executing their own due diligence, vetting, and physical safety assessments before entering into any formal service agreements, making financial deposits, or allowing any party onto residential or business premises.
4. Third-Party Advertisements and Partner Promotions
The Platform may feature advertisements, promotional materials, or links from third-party partners and Tradesmen targeting other users. EZYFIX does not vet, endorse, or assume any liability for the accuracy of these advertisements or the quality of goods or services offered by these external advertisers. Interacting with or purchasing from advertisers featured on EZYFIX is strictly at your own risk.
5. Limitation of Liability (Consumer Protection Act Compliance)
To the maximum extent permitted under the Consumer Protection Act 68 of 2008 (CPA) of South Africa, EZYFIX, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential losses, property damage, bodily injury, loss of profit, or financial loss arising from:
• The acts, omissions, conduct, or negligence of any Tradesman or Customer on or off the Platform.
• Structural, building, electrical, plumbing, or maintenance failures following a booking.
• Any contractual disputes, project delays, or payment disagreements between users.
(Note: This section does not limit or exempt liability for instances of proven gross negligence or intentional misconduct by EZYFIX itself, as strictly prohibited under Section 51 of the CPA).
6. Protection of Personal Information (POPIA Commitment)
EZYFIX is fully committed to protecting user privacy and processing data in strict compliance with the Protection of Personal Information Act 4 of 2013 ("POPIA").
• Data Processing: Any personal information (including ID numbers, proofs of address, company registration documents, and contact details) collected during verification or shared via platform utilities is processed lawfully, securely, and purely for the purpose of facilitating the marketplace operations.
• User-to-User Sharing: When you opt to use the Platform's features to request or share ID documentation and references, you explicitly consent to the transfer of that data to the receiving party. Once information is shared directly with another user, that user also carries legal obligations under POPIA to secure, legally process, and not misuse your data.
• For full details on data retention, access rights, and security safeguards, please review our comprehensive Privacy Policy (www.ezyfix.co.za/privacy).
Terms & Conditions — Dispute Resolution & Cancellation
Dispute Resolution & Cancellation Policy for EZYFIX
Disputes and Cancellations Between Users
1. EZYFIX is a Neutral Platform
Because EZYFIX is strictly an intermediary marketplace platform, we do not employ, manage, or act as an agent for any Tradesman, nor do we represent any Customer. Consequently, EZYFIX cannot and will not intervene, mediate, arbitrate, or dictate the outcome of any contractual disputes, quality issues, project delays, or cancellations between a Customer and a Tradesman.
2. Handling Cancellations
• Direct Agreement: Any cancellation of a booked project, quote, or service agreement must be negotiated and resolved directly between the Customer and the Tradesman.
• Applicable Terms: Cancellations are subject to whatever private terms, deposit rules, or service level agreements (SLAs) were agreed upon between the Customer and the Tradesman prior to commencing work.
• Refunds of Direct Payments: EZYFIX does not hold user funds and is not responsible for recovering, processing, or enforcing the refund of deposits or project payments made between users.
3. Governing Law and Legal Compliance
By using this Platform, both Customers and Tradesmen explicitly agree that any service agreement formed between them is governed by, and must be interpreted in accordance with, the laws of the Republic of South Africa. Both parties agree to handle all disagreements lawfully, ethically, and in a manner that respects South African statutory requirements.
4. Mandatory Step-by-Step Resolution Process
In the event of a dispute regarding poor craftsmanship, incomplete work, billing errors, or sudden cancellations, the parties agree to follow this framework:
• Step 1: Direct Negotiation. The Customer and Tradesman must first attempt to resolve the matter amicably and in good faith via direct communication.
• Step 2: Seek Professional Guidance. If direct negotiation fails, both parties are strongly encouraged and expected to seek independent external guidance from qualified legal professionals or relevant South African regulatory bodies.
5. Recommended South African Authorities for Guidance
Depending on the nature of the dispute, users should escalate their grievances to the appropriate legal or industry authority, such as:
• The Consumer Goods and Services Ombud (CGSO): For general consumer right violations and service delivery complaints under the Consumer Protection Act (CPA).
• The Small Claims Court: For financial or contractual claims that fall within the monetary jurisdiction of the Small Claims Court framework.
• Industry Regulatory Bodies: If the dispute involves professional negligence or safety violations, users should seek guidance from specialized bodies such as the National Home Builders Registration Council (NHBRC), the Electrical Conformance Board of South Africa (ECB), or the Plumbing Industry Registration Board (PIRB).
6. Indemnity
You agree to indemnify, defend, and hold harmless EZYFIX, its directors, and affiliates from any claims, demands, liabilities, or legal costs arising out of or connected to a dispute or cancellation between yourself and another user of the Platform.
